I worked in a bar for a while, long enough to know that bathroom stalls are used for all manner of things, many of which are not legal.

I have to part with the ACLU on this. If you are doing something illegal in a bathroom stall, you are not entitled to privacy. Just as if you are doing something illegal in your own home, you are similarly not entitled to privacy and the authorities can get a warrant from a judge to use surveillance to prove you are doing so. (Actually since the Patriot Act you don't even need to go through a judge, but I'm speaking strictly in terms of Constiutional Law which the Patriot Act does not conform to.)
