It doesn't include sex, because to me (and I would think in a legal sense, too), a public restroom is constructed and apportioned specifically for a particular purpose - going potty. That does not include sex. Especially because sex is an adult-oriented function and public bathrooms are frequented by minors, as well. On top of that (no pun intended), it is a morality issue. I think people who engage in or like to watch/hear public sex (it would not be private even in a stall) are sick. And I doubt that I'm in the minority on that. And on top of on top of that, despite what the ACLU says, if some one thinks that he/she has the level of expectation of privacy for performing sex in a public restroom, then I think he/she is not being realistic and indeed is being rather silly, maybe for shock value or something...? |

So your contention is that public restrooms are for one thing only going potty. And that other actions taken in these restrooms are not or should not be permitted? I can think of a bunch of other things one can do in a public rest room, things that normally occur, that did not include going potty. Should the people who engage in these actions also loss their right to privacy? Perhaps also be prosecuted for disturbing the peace by not utilizing the restroom to go potty? On top of that I would question whether you are in the majority regarding people who engage in or like to watch public sex acts. Further if a stall is a privet area minors should not be viewing the goings on in a occupied stall. I certainly would not like minors or anyone for that matter observing me or listening to me going potty. I would hope they would respect my privacy. |

You get enough people in the stalls and you can have a symphony!!!! There was a family guy clip I saw where he got into a bathroom farting contest with Michael Moore in the stall next door. They were playing dueling banjos. |

Sorry, Jag, just had to edit that last bit at the end of your post. No big deal, but some of our readers may have found that a little bit graphic. Anyone wanting anonymous sex with any gender in a public washroom already seems a little sick to me. I realize that sometimes couples like to try some public sex just for the thrill of it; I once caught a couple doing it on an elevator. "Thanks, I'll get the next one". Legalizing sex in public restrooms is absurd. I find the claims by the ACLU here to be laughable, as usual. |

I vote for sound proof cubicles, we could invent one and call it the 'Cone of Silence'. I cant stand it when I'm in a public toilet and the guy next to me goes Vesuvius, so loud that you can tell by the pitch whether it was Vindaloo or Chicken Korma. That is also offensive. The beat thing, I was always told that was the realm of married men |

Yes, it is for going potty. You have an expectation for privacy in your stall while you are pottying. Beyond that, you do not have an expectation of privacy. If you want to wash your hands, you do not have an expectation of privacy. If you want to talk with your friend about the new clothes you bought, you do not have an expectation of privacy. If you want to shower in the sink, you do not have an expectation of privacy. If you want to set off a cherry bomb, you do not have an expectation of privacy. If you want to brush your teeth, you do not have an expectation of privacy. If you want to knock off a hitman from the rival crime family, you do not have an expectation of privacy. If you want to solicit sex from a stranger, you do not have an expectation of privacy.
? So you think that the majority of people would like to engage in public sex and/or watch/hear it going on? |

What happens if a close family member just died and I got the news by telephone and retreated to a public bathroom stall for some privacy in that hard moment. I should not expect that privacy because I am not going potty?
I don’t know what the truth is. I just think it’s not as self evident as you make it out to be. You would have to provide proof of your statement, not merely state it. |

I've heard people cry in bathrooms. It's not completely private. Public bathrooms can provide privacy from sights, but not from sounds. |

I don't think so, no. You might get it and I doubt that others will "barge" in on you since you are occupying the stall at the moment, but I don't believe you can expect it, no. Others may overhear your conversation and it will not be private. It is a public space, after all.
