Inflamatory remarks made before or during the criminal act. (I'm going to kick your *derogatory remark* a$$ you *racist remark*.

Motive is seldom "written down" it goes to the criminals state of mind and is usually circumstantial in nature.

Motive goes why the crime was committed.

The stupidity of hate crime laws is that they make it possible to sentance someone to longer sentence due to motive rather then degree.

Take tow assault cases; in the first the defendant strikes the plaintiff once becuase they hate *insert group name here*. That person serves a longer sentence then someone who assiled thier victim with multiple blows becuse no hate is involved. Stupid.
