Should John Kerry be prosecuted under the UCMJ?

I don't remember if I had previously posted something about this, but I saw an article this morning in the American Thinker (yeah, I know, a typical evil right wing rag) regarding John Kerry and what he did after he returned from Vietnam.

I might have mentioned on a thread or two that he should have been prosecuted for lying to Congress, but this article goes to places I never did. I've mentioned treason because he met with a North Vietnamese delegation in Paris, but I didn't know he was still a reservist.

Article 36 of the UCMJ allows the President to prescribe rules and procedures to implement the provisions of the UCMJ. The President does this via the Manual for Courts-Martial (MCM) which is an executive order that contains detailed instructions for implementing military law for the United States Armed Forces.

The UCMJ states:

ART. 104. AIDING THE ENEMY 

Any person who--

(1) aids, or attempts to aid, the enemy with arms, ammunition, supplies, money, or other things; or

(2) without proper authority, knowingly harbors or protects or gives intelligence to or communicates or corresponds with or holds any intercourse with the enemy, either directly or indirectly;

shall suffer death or such other punishment as a court-martial or military commission may direct.


What it boils down to is that Kerry met with the Vietnamese Delegation in Paris in May 1970 and in March 1971. He was still in the Naval reserves at the time.

Interesting is that there are two different versions of John Kerry's Naval Service:

The analysis is that his people altered the records because of fear of prosecution under the UCMJ. I'd like Senator Kerry to answer this, and also SIGN FORM 180!
