Even though it's the offseason, the Plaxico Burress-New York Giants saga continues..

The players union filed legal briefs Friday, FOXSports.com has learned, in order to help Burress with a grievance he filed against the Giants. As a result of those filings, the extent of the actions the Giants took against Burress after he accidentally shot himself in November are coming to light.

The briefs, which were viewed by FOXSports.com, showed the Giants sent Burress a letter in December saying they were trying to recoup and withhold previous bonus money and future monies that could reach several million dollars. In fact, the Giants are looking to go after a portion of Burress' potential earnings up to the next four years and that includes a whopping 14 future escalators the Giants now think Burress should no longer be eligible to cash in on.

The Giants contend Burress defaulted on his contract as a result of his actions this past season.

Burress later filed his grievance to block the Giants from recouping the money.

The two sides will continue to battle even as Burress deals with his legal issues stemming from a Manhattan nightclub incident in which he shot himself in the thigh. Burress, 31, was arrested in late November on an illegal-gun charge.

Burress has been fined dozens of times since joining the team in 2005, and he was suspended for a game earlier in the 2008 season for missing a team meeting. He was also fined $45,000 by the NFL for abusing an official and throwing a ball into the stands during a game.

He finished the season with 35 receptions for 454 yards and four touchdowns.

In early December, the NFL Players' Association filed a grievance on behalf of Plaxico Burress, saying the Giants violated the collective bargaining agreement by suspending Burress. Then, when the team withheld a $1 million payment of his signing bonus, the NFLPA said it would come to Burress' defense again.

The union has filed all of the paperwork and Jay Glazer of FOXSports.com got his hands on it.

By withholding the bonus check, it was clear the Giants were preparing to make the argument Burress had defaulted on his contract. Glazer reports the team immediately put it in writing that "they were trying to recoup and withhold previous bonus money and future monies that could reach several million dollars." Remember, the only portion of Burress' contract that's guaranteed is the $4.25-million signing bonus. Glazer reports there are also "14 future escalators the Giants now think Burress should no longer be eligible to cash in on."

When the Giants initially suspended Burress, we at the Ledger were told by someone familiar with the team's thinking not to jump to conclusions about his future. I heard the same thing when the team withheld the bonus check. Now that I see the details of the Giants' stance on the issue, I still don't know what to think.

But again, this issue is out of the Giants' hands right now. If Burress goes to jail, there's no decision to be made. He's not playing, obviously, if he's behind bars. And in that case, the team has to show from the start they intended to recoup his bonus money. That's what they did when they withheld the check and wrote Burress the letter stating they believed he defaulted on his contract.

Now, if Burress avoids jail time, then it gets interesting. If they want him back, they'll have to work out a compromise and drop all the legal stuff.
